Re: Foundation for Creative Broadcasting, Inc. (KXCI) Your Formal Request Pursuant to A.R.S. §10-11601 Your Demand to Review Accounting Records

 

Dear Mr. Risner:

 

We are responding on behalf of KXCI to your letters dated February 20 and February 23, 2004.

 

Although we have some doubt about whether you meet the statutory requirements for your request for the accounting records, the information you requested in your letters will be available for you at the station on March 2, 2004 after 3:00 p.m. Please ask for Larry Bruce when you arrive.    Larry mentioned that you have a meeting scheduled with him on March 3; if you prefer, you can obtain the information at that time.

 

Larry also mentioned that you had requested mailing information for the current members of the Board of Directors. For KXCI business the Directors use KXCI's address: 220 South Fourth Avenue, Tucson, Arizona 85701. The current directors (whose names are also available on KXCI's website) are:

We are aware of the issues raised by Gary Wolf in a letter he sent you on February 19.  If Mr. Wolf is correct, and if either of your February 20 or 23 requests was made in your capacity as a member of or counsel to the KXCI Democracy Initiative, then your requests are inappropriate and you should refrain from picking up the records or participating in the meeting with Larry Bruce.
