Dear Mr. Bruce:
The Foundation for Creative Broadcasting, Inc. (FCB) President
Thomas Spendarian designated you to receive the initiative petitions signed by members of FCB. The petitions we are presenting
today are numbered one through four hundred and eighty three (1-483). The petitions to change the by-laws of FCB are in accordance
with the right of the members to initiate an election to change the by-laws as requested.
We found that some of the signers did not appear on our copy of current members. We have included those
signatures, nonetheless. Our review of the signatures with the membership list took us only a few hours and demonstrated that
the number of signatures greatly exceeded the 10% requirement of the by-laws, or approximately 270 signatures. We numbered
each of the petitions in order to facilitate the examination and counting of signatures of current members. Based on our verification
we are confident that you will be able to inform the board prior to their Thursday, January 15, 2004 meeting that they are required to schedule an election as requested.
The KXCI Democracy Initiative leadership group is disappointed
that the FCB board for several months has refused to meet with us as we formally requested to discuss needed changes in board
policies. Those discussions are now moot. However, we would like to discuss with the board or representatives of the board
the mechanics of an election that would have the confidence of the membership. All of our supporters are strong and active
supporters of KXCI. We want the station to be strong, financially sound, and operated in the best interest of the community.
Our disagreements should be limited to policy.
The FCB board responded to our request for the membership list
for the purposes of this initiative by violating the rights of its members and wasting over $5,000 in members' contributions.
The board responded with silence to our request for dialogue. The board refuses to allow members to speak at meetings. We
now ask the board to change its way of doing business and listen to the desires of Its members. Let
us work together on this election.
